Welcome to PLANTYERA ("PLANTYERA," "we," "our," or "us"). By accessing or using this website, creating an account, or placing an order, you agree to these Terms & Conditions. If you do not agree, please do not use this website.

1. Eligibility

You must be at least 18 years old or have the permission of a parent or legal guardian to make purchases through this website.

2. Products

PLANTYERA offers products including, but not limited to:

  • Live Houseplants

  • Plant Cuttings

  • Seeds

  • Plant Supplies & Accessories

  • Handmade Jewelry

  • Home Decor

  • Botanical Graphics, Artwork and Photography

  • Digital Downloads

  • Gift Cards

  • Memberships and/or Subscriptions

Availability is subject to change without notice.

3. Product Descriptions

We strive to accurately describe and photograph every item.

Because many of our products are handmade or living plants:

  • Individual plants naturally vary in size, color, shape, variegation, and growth habit.

  • Lighting and camera/monitor variations may slightly alter the true appearance of items viewed online.

  • Handmade products may have slight variations, especially if made to order.

  • Product photos are representative examples and may not always depict the exact item received unless specifically stated.

These natural differences are not considered defects.

4. Pricing

Prices are listed in U.S. Dollars.

We reserve the right to:

  • Change prices at any time

  • Correct pricing errors

  • Cancel orders resulting from pricing mistakes

If payment has already been processed for an unavailable item or pricing error, we will issue a refund.

Promotions, sales, and discounts may have restrictions such as quantity minimums/maximums, order minimums/maximums, may be limited to specific individuals or groups, or offered for a limited/specified amount of time.

5. Orders

Submitting an order does not guarantee acceptance.

PLANTYERA reserves the right to:

  • Refuse or cancel any order

  • Limit quantities purchased

  • Cancel suspected fraudulent transactions

  • Cancel orders due to inventory shortages or unforeseen circumstances

If your order is canceled after payment, you will receive a refund for the canceled items.

6. Payment

Payments are processed securely through trusted third-party payment processors.

PLANTYERA does not store complete payment card information.

7. Local Pickup & Delivery

When local pickup or local delivery is offered:

  • Customers are responsible for collecting orders during the predetermined pickup window.

  • Items not picked up within the specified window may be returned to inventory and made available for purchase, unless the customer has prepaid for the item(s).

  • Prepaid items must be picked up within 2 weeks, unless other arrangements have been made. Items not picked up within 14 days of prepayment will be returned to inventory and made available for purchase. Should this occur, the PLANTYERA will make an attempt to contact the customer on Day 14 and a refund will be issued prior to relisting the item(s).

  • Valid identification may be requested upon pickup or delivery.

  • During seasons of extreme heat or cold or severe/inclement weather, PLANTYERA may modify or temporarily cease pickup/delivery services for live plants to prevent damage.

  • PLANTYERA is not responsible for damage resulting from delays in care after pickup/dropoff.

Additional pickup or delivery policies may be posted separately.

8. Shipping

If PLANTYERA offers shipping in the future:

  • Shipping timelines are estimates.

  • Delivery delays caused by carriers, weather, or other circumstances beyond our control are not guaranteed.

  • Risk of loss transfers to the customer once the package is accepted by the shipping carrier, except where prohibited by law.

9. Live Plant Disclaimer

Plants are living organisms. Their appearance may change due to:

  • Seasonal growth

  • Lighting

  • Humidity

  • Temperature

  • Watering practices

  • Normal acclimation after purchase

Plant health after delivery or pickup depends largely on environmental variables (light, temperature, humidity), as well as, the attention and care provided by the customer.

PLANTYERA is not responsible for damage to live plants that occurs once the plant is in the possession of the customer.

Plant care information is offered as general guidance and does not guarantee results.

PLANTYERA will never knowingly sell plants with active pest infestations.

As an added layer of precaution, customers are encouraged to inspect plants closely upon pickup/delivery, treat preventatively upon entering the home, and isolate the plant from other household plant populations for a period of 2 weeks to ensure pests are not present.

10. Digital Products

Digital products are licensed for personal use unless otherwise stated.

Customers may not:

  • Redistribute

  • Resell

  • Share

  • Modify for resale

  • Claim ownership

All copyrights remain the property of Amber Liebau and/or PLANTYERA.

11. Intellectual Property

All website content—including photographs, logos, product descriptions, graphics, branding, artwork, and written content—is owned by PLANTYERA unless otherwise noted.

No content may be copied, reproduced, or used without prior written permission.

12. Customer Accounts

Customers are responsible for maintaining the confidentiality of their login credentials.

PLANTYERA reserves the right to suspend or terminate accounts that violate these Terms.

13. Loyalty Programs & Memberships

PLANTYERA may offer loyalty rewards, memberships, subscriptions, or promotional programs.

We reserve the right to:

  • Modify Benefits

  • Update Eligibility Requirements

  • Discontinue programs

  • Correct reward balances resulting from system errors

  • Revoke access and privileges if terms & conditions or other specified rules and/or policies are violated by the customer.

Reasonable notice will be provided when practical.

14. Acceptable Use

You agree not to:

  • Use the website for unlawful purposes

  • Attempt unauthorized access

  • Interfere with website functionality

  • Submit malicious code

  • Misrepresent your identity

  • Violate intellectual property rights

  • Share or distribute discount codes en masse that are issued as benefit of Membership or Subscription

PLANTYERA reserves the right to cancel or ban access, membership or subscription of individuals suspected or confirmed to be in violation of any or all of the above.

15. Limitation of Liability

To the fullest extent permitted by law, PLANTYERA shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of this website or purchased products.

Our total liability shall not exceed the amount paid for the applicable order.

Nothing in these Terms limits rights that cannot legally be waived under applicable law.

16. Disclaimer of Warranties

Except as expressly stated, products and services are provided "as is" and "as available."

PLANTYERA disclaims all implied warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose.

17. Governing Law

These Terms & Conditions are governed by the laws of the State of Kansas, without regard to its conflict of law principles.

18. Changes to These Terms

We may revise these Terms & Conditions at any time.

Updated versions become effective upon posting to this website.

Continued use of the website constitutes acceptance of the revised Terms.
